Ohio Senate Bill 130, which would establish licensing and regulations for “high volume breeders” is scheduled for two hearings next week (September 11 and September 12) in the House Agriculture & Natural Resources Committee.

Numerous positive amendments were made in the Senate to protect the health and welfare of dogs and the rights of responsible dog breeders; however, a substitute bill distributed late last week made some problematic changes to the bill.

Ohio dog owners and breeders are encouraged to respectfully contact the committee with any comments or concerns regarding the most recent version of Senate Bill 130. Negotiations are ongoing to amend the bill to address concerns, and more information will be provided as it becomes available.

The AKC is requesting some changes to the substitute bill as currently written, including:Definition of “High Volume Breeder” – The Senate version of the bill defined a “high volume breeder” as one who produced nine litters and sold 60 puppies in a calendar year.  The substitute version of the bill removes the sales component (thereby changing to definition to just someone that produces 9 litters/year). We believe that this threshold should be based on sales, rather than solely on the number of litters produced. This is especially important as the bill implies that the sale of one dog from a litter constitutes the sale of a whole litter. It could also unfairly impact those who may meet this threshold, but have a very small number of dogs (perhaps even one dog) in each litter. AKC is respectfully requesting that the threshold remain at producing nine litters and selling at least 60 puppies in a calendar year.

Definition of “kennel”- We remain concerned about the definition which, as amended in SB 130, is defined as any establishment that keeps, houses, and maintains adult dogs for the purpose of breeding the dogs for a fee. It is very difficult to determine whether or not someone intends to breed a dog, as owners keep intact dogs for a variety of reasons, including the ability to participate in AKC conformation dog shows and trials. The AKC has requested that this amendment be stricken and the definition remain as it is in current law, which clarifies that a kennel is defined as those who are “professionally engaged in the business of breeding dogs…”, rather than encompassing owners of intact dogs or hobby breeders who may occasionally breed a litter in their home.
