A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION

AS TO PROHIBIT THE DENIAL, CANCELLATION, OR NONRENEWAL OF HOMEOWNERS
INSURANCE BASED SOLELY ON THE PRESENCE OF ONE OR MORE DOMESTICATED
DOGS ON THE HOMEOWNERS' PREMISES, UNLESS A SPECIFIC DOG ON THE
PREMISES HAS A DOCUMENTED HISTORY OF CAUSING SIGNIFICANT DAMAGE TO
REAL OR PERSONAL PROPERTY OR SERIOUS BODILY INJURY TO A PERSON.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.  Article 9, Chapter 75, Title 38 of the 1976 Code is
amended by adding:

Notwithstanding any other provision of law, no insurer may deny an
application for homeowners insurance, cancel a policy for homeowners
insurance, or nonrenew a policy for homeowners insurance solely on
the basis that one or more domesticated dogs reside on the
homeowners' premises unless a specific dog residing on the
homeowners' premises has a documented history of causing:

(1)  significant damage to real or personal property; or

(2)  serious bodily injury to a person."

SECTION    2.  This act takes effect upon approval by the Governor.
